An open Letter for Indian Judiciary

Judiciary is a respected institution in India and judges/judicial officers are more or less respected by the People of India. Although Judiciary in India is not free from corrupt practices. PF Scam of Ghaziabad U.P. etc. is a bitter pointer to the scourge. The rot is deep rooted like in almost all other institutions of public life in India. It is a matter of great concern that the Judiciary need to be above all suspicions as they say 'Caeser's wife should be above all suspicions'. This is possible only if transparency is ensured in all processes involving the Judiciary such as appointments, disciplinary rules, service conditions etc. of all judicial officers/judges/personnel.

There has been a public debate going on whether Judges in India should declare their assets or not. Saafnations believe that Judges are public servants and the public has the right to know the assets possessed by the Judicial officers. The assets should include all moveable and immovable properties possessed by all judicial officers associated with the process of delivering justice leave alone the judges of High courts and the supreme courts.

Judiciary has not only to maintain highest level of balance and integrity, but it has also to be seen to be doing that to the public eye. Sometimes the public may underestimate the integrity of individual judges and overestimate their actual assets. This leads to an unfair appraisal of the concerned judges which in turn may demoralize them. In order to be fair it own self, it is imperative that the judges and all other judicial officers connected with the administration of justice not only declare their assets/moveable and immovable etc.but also declare their assets regularly so that their image and reputation for integrity sours higher than the public perception. This will not in any way undermine the authority of the judicial officers, but it will add to the health and credibility of Judiciary in India.

Saafnations, therefore appeals to the entire judicial community to take the initiative and all appropriate measures to declare all moveable and immoveable assets of all the judges/judicial officers/personnel in the public domain.

Tackling political corruption here requires at the minimum a reconceptualizing of the Integrity Commission

By Stabroek staff July 23, 2010 in Letters Dear Editor, In 1968 Samuel Huntington argued that by greasing the wheels of the economy and so removing bureaucratic and other practices that impede investments and development, political corruption is efficiency-enhancing and inevitable (“Political Order in Changing Societies”). However, notwithstanding Huntington and others, national societies caught in the spiral of massive political plunder (see following table) rejected this view.
